Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of onthemk.com (the "Site"), operated by On The Mark ("On The Mark," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Use of the Site

You may use the Site for lawful, personal, and business informational purposes only. You agree not to:

  • Use the Site in any way that violates applicable law or regulation;
  • Attempt to gain unauthorized access to the Site, its systems, or related networks;
  • Scrape, harvest, or reproduce Site content at scale without our written permission; or
  • Interfere with the Site's normal operation, including through malicious code or excessive automated requests.

Intellectual Property

All content on the Site — including text, research, executive briefs, graphics, logos, and the "On The Mark" name and mark — is owned by On The Mark or its licensors and is protected by copyright and other intellectual property laws. You may view, download, and share individual executive briefs for your own internal, non-commercial reference, provided you do not alter them or remove attribution. The same applies to other free resources we make available for download, such as the Healthcare Workforce Executive Scorecard (delivered through our third-party partner, Payhip): they are for your own internal, non-commercial use only, and may not be redistributed, resold, modified, or white-labeled without our prior written authorization. Any other reproduction, redistribution, or commercial use requires our prior written consent.

Not Professional Advice

Content on the Site — including executive briefs, workforce data, and insights articles — is provided for general informational purposes only. It does not constitute, and should not be relied upon as, legal, financial, clinical, or personalized workforce-strategy advice for your organization. Decisions about staffing, compliance, or clinical operations should be made in consultation with qualified professionals familiar with your specific circumstances.

Newsletter & Communications

If you subscribe to our newsletter or contact us through the Site, you consent to receive communications from us related to that request. You may unsubscribe from marketing emails at any time using the link provided in those emails. See our Privacy Policy for more on how we handle your information.

Third-Party Links

The Site may link to third-party sites, such as LinkedIn and Payhip (which we use to process checkout and deliver certain free resources, such as the Healthcare Workforce Executive Scorecard), that we do not own or control. We are not responsible for the content, policies, or practices of any third-party site, and inclusion of a link does not imply endorsement.

Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or that the research and data presented are complete, current, or error-free at all times.

Limitation of Liability

To the fullest extent permitted by law, On The Mark and its founder will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, revenue, or business opportunity, arising from your use of, or inability to use, the Site — even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law.

Governing Law

These Terms are governed by the laws of the state or jurisdiction in which On The Mark operates, without regard to conflict-of-law principles. Any disputes arising from these Terms or use of the Site will be resolved in the courts of that jurisdiction.

Note to site owner: Replace the paragraph above with your specific state/jurisdiction (for example, "the State of Delaware") once confirmed, ideally with an attorney's input.

Changes to These Terms

We may revise these Terms from time to time. The "Last updated" date at the top of this page reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms.

Note to site owner: This page is a general-purpose template, not legal advice. Have it reviewed by an attorney before relying on it, particularly the governing-law and liability sections, to make sure it fits how your practice actually operates.
